    The federal anti-monopoly service of Russia suggests resolving legislatively mutual relations of the pharmaceutical companies with medical community

    The federal anti-monopoly service of Russia suggests resolving legislatively mutual relations of the pharmaceutical companies with medical community.


    The federal anti-monopoly service (FAS Russia) has presented the project of the federal law «About modification of certain legislative acts of the Russian Federation» on Expert council for competition development in social sphere and public health care services. The bill provides amendments to Bases of the legislation of the Russian Federation about health protection of citizens and the Code of the Russian Federation about administrative offenses, and also offers to the project of the federal law «About the reference of medical products».

    Offers assume restrictions in activity of the pharmaceutical companies and medical workers at advancement of medical products on the market, regulate procedure of post clinical researches of medical products, define the order of prevention and settlement of the conflict of interests of medical workers, and produce administrative liability of infringement of the specified demands and restrictions.

    Innovation of FAS of Russia is introduction of concept the conflict of interests in relations the doctor - the pharmaceutical company. In the bill offered by anti-monopoly service, is a situation at which the medical worker who has entered into the agreement in the oral or written form with the organization (establishment), carrying out pharmaceutical activity, has a reception possibility personally or through the legal or actual representative of the pharmaceutical company, material benefit or other wrongful advantage in the course of realization medical worker influences or can affect appropriate execution of professional duties by it owing to the contradiction between personal interest of the medical worker and interests of the patient.

    In case of occurrence or possibility of occurrence of the conflict of interests the medical worker should inform in writing on a current situation of the principal.

    FAS Russia suggests to define by the law the restrictions imposed on medical workers at realization by them of professional work.
    FAS Russia suggests to fine medical workers for not providing data on the conflict of interests on 20-30 thousand roubles. The anti-monopoly service suggests assigning control over observance of this norm to Russian Health Supervision.
    The pharmaceutical companies under bill FAS of Russia are forbidden to enter into with medical workers of the agreement on diffusion of medical products, to give the false or incomplete information on the medicinal preparations offered for appointment patients.
    Non-compliance by the pharmaceutical company, the pharmaceutical worker, the representative pharmaceutical the companies of the restrictions established by the law, will entail applying of the administrative penalty on citizens from ten roubles to thirty thousand, on officials - at the rate from thirty roubles to fifty thousand or disqualification for the term from one year till two years, on legal bodies - from one 100-th till 15 100-th sizes of the sum of a gain of the offender from sale of goods (work, service), in which market absolutely administrative offense, but not less than three hundred thousand roubles.

    Following the results of discussion the decision on creation of two working groups with participation of representatives of the pharmaceutical companies and medical community for completion of offers under the bills specified above was accepted.
